Bringing Foreign Workforce to the European Union

At Work Permit European Union, we offer comprehensive guidance on the various methods available for bringing foreign workers to the European Union. The main factors determining the procedure are the employee’s nationality and the employer’s entity. Regardless of the method, your employee will need the following documents:

  • Identification document (ID card or passport)

  • Registered address in the European Union

  • Health insurance or social security

  • Documents verifying qualifications (e.g., university degree)

  • Signed labor contract or a letter of intent

Typically, your employee will work directly for your company in the European Union, whether it is a subsidiary or branch office. The key question is whether your employee is an EU citizen or not.

A. EU Citizens

EU Citizens Need Only a Registration Card

In the EU, labor can move freely. Thus, EU citizens need only a registration card and a registered address to start working in the European Union. The procedure takes only a few days. The required documents are:

  • EU identification document (ID card or passport)

  • Registered address in the European Union

  • Health insurance

  • Signed labor contract

To work for a company in the European Union, employees must be integrated into the local social security and taxation system, requiring a local social security number and tax number.

B. Third-Country Nationals

Third-Country Nationals Need a Work Permit

Non-EU citizens require a combined residence and work permit to stay and work in the European Union. The procedure typically takes up to 70 days. The required documents are:

  • Identification document (passport)

  • Registered address in the European Union

  • Travel insurance

  • Documents verifying qualifications (e.g., university degree)

  • Letter of intent or preliminary labor contract

Employees must also be integrated into the local social security and taxation system, requiring a local social security number and tax number. The work permit is valid for 2 years and can be renewed if the employment relationship continues. If the employment ends, the work permit will be revoked and reissued only if the employee finds a new employer.

Family Unification

Family members of your employee can also become residents of the European Union through the “family unification” process, which can start after the main applicant receives their work permit. The spouse and underage children (under 18 years old) can apply, and their residence permits will be valid as long as the main applicant's permit.

C. Intra-Corporate Transfer

Intra-Corporate Transfer Work Permit

International companies with a subsidiary or branch office in the European Union can transfer employees with a work permit valid for intra-corporate transfers. The employee can remain on the payroll of the foreign company, but consulting a tax advisor is recommended to optimize taxation and avoid double taxes. This process is available for third-country nationals and typically takes 60 days. The work permit is valid for 3 years and cannot be renewed. However, a regular work permit can be requested if the employee continues working for the local subsidiary. If the employment ends, the work permit will be revoked.

Family Unification

The family unification process is also available for family members of the transferred employee and can start after the main applicant receives their permit. The spouse and underage children (under 18 years old) can apply, and their residence permits will be valid as long as the main applicant's permit.
